Road opening permit

A Road Opening Permit approval is usually sought for the purpose of construction (or associated works) along a road, or roads reserve, that is within Council’s jurisdiction. The permit is sought under the Roads Act 1993, and the applicant is required to apply for permission prior to undertaking any works.

Works that might require a Road Opening Permit approval

  • Irrigation channels
  • Underbore testing or drilling any section of roads or road reserve
  • Repairs or installation of services or service pipes (water, sewer, stormwater)
  • Erection of a sign
  • Concreting
  • Upgrade of roads or intersections
  • Culvert installations

This application does not cover permanent driveways or replacing redundant driveways with new footpaths. These require a 'Driveway/Crossover Application' to be completed.

Through the assessment process you may also be asked for the following, depending on the nature of the works:

  • Traffic Guidance Scheme (TGS - such as GAME or GOTraffic can produce – by licenced practitioners only). This is to ensure correct and compliant use of public notification will be in place during construction (sign boards, traffic lights, use of traffic cones, etc).
  • Builder’s insurance details

 

Submit an application

Step 1.Login to the MRC Customer Portal

Head to our Customer Portal: login or create an account.

Step 2.Commence your application

  • Once your account is set up, you can commence your application via the portal.
  • Head to the ‘Applications’ section on your home page, then ‘Permits, Licences and Approvals’.
  • Select the ‘Roads Act - Road Opening Permit (Section 138 & 139)’ option from the drop-down menu to start.

Step 3.Submit for review

Once the application is submitted through the Portal, an initial review will be carried out to check the information provided is sufficient for Council to accept. If we need more information before the application can be accepted, an officer will contact you to request this information or for further clarification.

Step 4.Assessment

Our officers will assess the application and notify you of the outcome.
